1. Preamble
These terms of sale govern all transactions conducted at the Santacruz Surf Camp managed by AVAQ Company. By participating in any transaction, customers unconditionally accept and agree to abide by these terms.
2. Object
The contract established between customers and AVAQ Company pertains to the provision of services at the Santacruz Surf Camp. This contract outlines the rights and obligations of both parties regarding the services offered through the camp.
3. Definitions
In this contract:
- "Surf Camp Services" refers to the activities and accommodations provided by AVAQ Company at the Santacruz Surf Camp.
- "Customer" refers to any individual who engages with AVAQ Company for the purpose of availing Surf Camp Services.
- "Reservation" signifies the act of booking Surf Camp Services by the Customer.
4. Reservation
All reservations for Surf Camp Services are subject to availability. AVAQ Company reserves the right to refuse or cancel any reservation at its discretion. Customers must adhere to the reservation policies outlined by AVAQ Company.
5. Booking Process
Customers can make reservations for Surf Camp Services by contacting AVAQ Company directly or through the official website. Upon confirmation of the reservation, Customers agree to the terms and conditions specified by AVAQ Company.
6. Payment
The prices for Surf Camp Services are listed in Moroccan Dirhams and are exclusive of taxes. Payment is required at the time of reservation, and AVAQ Company accepts various payment methods as indicated on the booking platform.
7. Cancellation Policy
Customers may cancel their reservation in accordance with the cancellation policy set forth by AVAQ Company. Cancellation requests must be submitted within the specified timeframe to qualify for refunds or credits.
8. Liability
AVAQ Company shall not be liable for any damages, losses, or injuries incurred by Customers during their participation in Surf Camp Services. Customers acknowledge and assume all risks associated with surfing and related activities.
9. Force Majeure
AVAQ Company shall not be held responsible for any failure to fulfill its obligations due to circumstances beyond its control, including but not limited to natural disasters, government actions, or acts of terrorism.
10. Governing Law
These terms of sale shall be governed by and construed in accordance with the laws of Morocco. Any disputes arising out of or related to these terms shall be resolved through arbitration in Morocco.
11. Data Confidentiality
AVAQ Company is committed to protecting the confidentiality and privacy of Customer data. Any personal information collected during the reservation process or provision of Surf Camp Services will be handled in accordance with applicable privacy laws and AVAQ Company's privacy policy. Customer data will only be used for the purpose of fulfilling reservations and improving the quality of services offered at the Santacruz Surf Camp. AVAQ Company will not disclose or sell Customer data to third parties without prior consent, except as required by law or legal process. Customers have the right to access, update, or delete their personal information by contacting AVAQ Company's designated privacy officer. By making a reservation and/or participating in Surf Camp Services, Customers consent to the collection and use of their personal data as outlined herein.
